RETAINER SERVICE AGREEMENT

This agreement is entered into as of the day of

by and between

hereafter referred to as the "Client" and PLANCHER SECURITY & INVESTIGATION, LLC hereafter referred to as "Company".

 

This agreement will confirm that Client is acquiring investigative services with Plancher Security & Investigation, LLC; where office is located at 1950 Courtney Drive, Suite 203, Fort Myers, Florida 33901, Private Investigation Agency License # A1500018, as a private investigator in the following assignment: 

SERVICE INFORMATION

Type of investigation needed?

The Client understands that Company in its best efforts will investigate the manner described by the client above. The Client agrees to allow Company and their investigators sole discretion to investigate the above stated manner by any lawful means that may be appropriate or deemed necessary. Company reserves the right to use any investigator assigned by Company to perform the investigative work on behalf of the Client. Company acknowledges that only licensed investigators will be used to work on the investigation assignment. 

Should multiple investigators be used to perform the investigation (i.e. more than one investigator used for a surveillance), the Client's prior approval will be obtained. If multiple investigators are approved to work assignment, the same hourly expenses listed will be applied per approved investigator. Company and their agents in the course of the investigation assignment shall use discretion when obtaining information. It should be noted that there is no guarantee as to the results obtained during the investigation. No information will be obtained illegally or unethically. Information collected will be reported or withheld upon investigator(s) digression. The investigator(s) assigned to this assignment shall be diligent, productive and use their abilities to complete the assignment in a timely manner. 

The investigator has discretion in selecting investigative dates and times unless dates and times are agreed upon.

CLIENT INFORMATION

How did you hear about us?

The Client shall pay Company five-hundred and fifty ($550 usd) dollars ($100 per hour, minimum (5) hours,+6.5% sales tax and 3.5% processing fee) to serve as an initial retainer to begin investigative efforts. Company will only work within the budget of the provided retainer. The Client will be notified when eighty (80%) percent of the budget has been exhausted. Investigative efforts will cease when the retainer/budget has been exhausted and will resume when a new retainer is received by Company. Investigation efforts will not begin until the retainer is received by Company.

In the event of a default in payment to sums owed to Company, and this agreement is placed in the hands of an attorney at law for the purposes of collecting outstanding payments due, the client, agrees to pay all costs of collecting including but not limited to reasonable attorney fee incurred by Company. 

SUBJECT INFORMATION

Company agrees to conduct surveillance on behalf of the Client with the subject(s) of the investigation being:

PAYMENT REQUIRED

Private Investigation / Surveillance Services ($100 per hour, minimum (5) hours, +6.5% sales tax and 3.5% processing fee)
$550

Company hourly rate for this assignment is $100.00 per hour, plus 6.5% sales tax, 3.5% processing fee, and any out of pocket expenses including but not limited to mileage at the rate of $0.67 per mile, search report expenses and purchasing of any documents related to the investigation. Company will bill Client for time expended towards this assignment in increments of $100.00 an hour. The administration time (report writing and video compiling) are included at no additional cost to Client. All billed time and expense will be deducted from the retainer and/or invoiced following activities and receipts will be provided for expenses if available.


If it becomes necessary for an investigator to testify at a deposition or in court, Company shall be compensated at the hourly rate of $250.00 and mileage at the rate of $0.67 per mile, search report expenses and purchasing of any documents related to the investigation. Invoices for depositions or court appearances are due to the Company no later than fifteen business (15) days from the receipt of the invoice. Payments received after, will include a 1.5% late fee per each additional day that the invoice is left unpaid. In the event of a default in payment to sums owed to the Company and this agreement is placed in the hands of an attorney at law for the purposes of collecting outstanding payments due, the Client, agrees to pay all costs of collecting including but not limited to reasonable attorney fee incurred by the Company. 

CLIENT ACKNOWLEDGEMENT 

The Client acknowledges and understands that any interference from the Client, friends of the client or associates of the client will hinder the ability for the Company to provide the services under this agreement.  Interference includes but is not limited to calling the subject, driving passed the surveillance location, or visiting locations associated with the surveillance.


The Client agrees not to interfere with the investigation in any manner whatsoever or instruct anyone else to interfere with the investigation directly or indirectly. The Client agrees that if anyone participates in the investigation during which time the Company is working for the Client, the Company will discontinue all investigative activity and the client will forfeit any unused portion of the retainer.


The Client certifies that Client has no previous history of violence and/or harassment and agrees that any and all findings will not be used as blackmail and will not be used for harassment or harm.


The Client certifies that they have read, understand and accept the Terms and Conditions in this agreement.

CLIENT MISREPRESENTATION

The Client confirms that they have not misrepresented themselves in any manner regarding the investigative assignment. The Client understands that if the Company believes the Client has purposely misrepresented themselves or omitted information in this agreement, it may result in criminal or civil action against the client. 

INFORMATION SOURCE ACCURACY 

The Client understands that any inaccurate information provided to the Company which includes inaccurate spelling may result in inaccurate or wrong information being secured for a subject. The Company is not liable or responsible for the inaccuracy of information located or provided from government agencies, public information agencies, websites or third-party information sources. The Company provides no warranties or guarantees, expressed or implied as the accuracy of the information that is located or received or provided. The Company will not be responsible for losses or damages caused by the use of the data provided to the client.
